Press Council Nepal Targets Hulaki News for Publishing News about Dr. CK Raut
Press Council Nepal seeks clarification from Hulaki News for publishing news about Dr. CK Raut. This is not the first time Press Council has targeted Dr. Raut or Hulaki News.
Forced Closure of Hulaki News by NTA
Just a year earlier, the online newsportal Hulakinews was forcibly closed by local telecomm operator Ncell due to the written orders by Nepal Telecommunications Authority (NTA). No reason for this closure was specified. However, Ncell’s parent company, Teliasonera issued a statement few months later to support press freedom, inquired with NTA about the reason for this closure and restored the website of Hulaki News. The statement was titled, “Freedom of Expression – Unconventional request as to blocking of a website in Nepal”. A quote from the statement reads,
In Nepal, mid-August, the website www.hulakinews.com, by a written order from the Nepal Telecommunications Authority (NTA), was blocked by the local operators, including TeliaSonera’ local subsidiary Ncell. The order was unspecified as to period of time but was then unblocked end of August.

Crackdown on Dr. CK Raut by Press Council
Similarly, Press Council Nepal has repeatedly cracked down to curtail freedom of expression for Madhesi activist Dr. Chandra Kant Raut. On May 12, 2016, it demanded a public apology from ABC Television for broadcasting the interview of Dr. CK Raut, a Nepali citizen with full freedom of expression guaranteed by the constitution. ABC Television defended its right to broadcast diverse opinions.
Similarly, on January 19, 2017 the Press Council Nepal published a statement that threatened to take action against any media that published reports about “some individuals” whose actions might disturb national sovereignty, territorial integrity and social harmony. Coincidentally, this statement was released just a day after Dr. Raut’s program in Lahan, Saptari, Nepal. The Council has attempted on multiple occasions to restrict the “freedom of expression” guaranteed in Article 17(2) of our constitution.

काठमाडौँ, २५ माघ । प्रेस काउन्सिल नेपालले मुलुकको सार्वभौमसत्ता, राष्ट्रिय अखण्डता, राष्ट्रिय एकता र सामाजिक सद्भावविरुद्ध अभियान सञ्चार गर्दै आएका सिके राउतको आपत्तिजनक अभियानलाई प्रोत्साहित र प्रचारप्रसार हुने गरी श्रृङ्खलावद्ध रूपमा समाचार गरेको भन्दै हुलाकीन्यूज डट कमसँग स्पष्टीकरण माग गरेको छ ।
काउन्सिल अध्यक्ष बोर्णबहादुर कार्कीले आज आचारसंहिता कारबाही आदेश जारी गर्दै सो डट कमलाई ३ दिनभित्र स्पष्टीकरण पेश गर्न निर्देशन दिनुभएको हो ।
कारबाही आदेशमा उल्लेख गरिएको छ –‘पेश भएको प्रतिवेदनअनुसार पत्रकार आचारसंहिता २०७३ को दफा ५(१) मा “पत्रकार र संचारमाध्यमले नेपालको सार्वभौमसत्ता, भौलिक अखण्डता, राष्ट्रियता विरुद्ध सामाग्री उत्पादन, प्रकाशन, प्रसारण र वितरण गर्नु हुँदैन” भन्ने व्यवस्था भएकोमा सोको विपरीत हुलाकीन्यूज डट कम (hulakinews.com) ले उपरोक्त समाचार सम्प्रेषण गरी पत्रकार अचारसंहिता उल्लंघन गरेको प्रारम्भिक अनुुसन्धानबाट देखिएको हुँदा यस्ता पत्रकार आचारसंहिता विपरित समाचार सामग्री सम्प्रेषण नगर्नु नगराउनु भनी निर्देशन दिने र आचारसंहिता उल्लंघन गरेकोमा कारबाही किन हुनु नपर्ने हो ३ दिनभित्र जवाफ दिनु भनी स्पष्टिकरण माग गर्ने ।’
अध्यक्ष कार्कीको सो निर्देशनलगत्तै काउन्सिलका सहप्रशासकीय अधिकृत दीपक खनालले आजै हुलाकी डट कमको नाममा पत्राचार गरी ३ दिनभित्र स्पष्टीकरण पेश गर्न माग गर्नुभएको छ ।
सूचना अधिकारी समेत रहनुभएका खनालले जारी गर्नुभएको पत्रमा भनिएको छ–‘पत्रकार आचारसंहिता, २०७३ को दफा ५(१) मा “पत्रकार र सञ्चारमाध्यमले नेपालको सार्वभौमसत्ता, भौगोलिक अखण्डता र राष्ट्रियता विरुद्ध सामग्री उत्पादन, प्रकाशन, प्रसारण र वितरण गर्नु हुँदैन” भन्ने व्यवस्था भएकोमा सोको विपरीत उपरोक्त समाचार सम्प्रेषण गरी पत्रकार अचारसंहिता उल्लंघन गरेको देखिँदा पत्रकार आचारसंहिता विपरीत यस्ता समाचार सामग्री सम्प्रेषण नगर्नु÷नगराउनु हुन र उपरोक्त सम्बन्धमा ३ दिनभित्र स्पष्टीकरण पेश गर्नुहुन निर्देशानुसार जानकारी गराइन्छ ।’
पत्रमा उल्लेख छ –‘मुलुकको सार्वभौमसत्ता, राष्ट्रिय अखण्डता, राष्ट्रिय एकता र सामाजिक सद्भावविरुद्ध अभियान सञ्चार गर्दै आएकोमा त्यस्तो आपत्तिजनक अभियानलाई प्रोत्साहित र प्रचारप्रसार हुने गरी श्रृङ्खलावद्ध रुपमा मिति २०७३ माघ २१ र २३ गतेमा “स्वतन्त्र मधेश गठबन्धनका संयोजक सि.के. राउतको रिहाइका माग”, “जयकृष्ण गोइतले भने डा. राउतलाई विनाशर्त रिहा गर”, “सि.के. राउतका समर्थहरुद्वारा मधेशभरि प्रदर्शन”, “डा. राउतको रिहाइको लागि शान्तिपूर्ण प्रदर्शन जारी”, “डा. राउत र उनका समर्थकलाई अविलम्ब रिहा गर” आदि समाचार सामग्री तपाईंद्वारा सम्पादित हुलाकीन्यूज डट कममा सम्प्रेषण गरेको प्रारम्भिक अनुसन्धानबाट पाइयो ।’
